4. Intellectual and Industrial Property.
The User acknowledges that all the contents of the online platform and, in particular, all the information and materials, the structure, selection, arrangement and provision of its contents, programmes and application development used in relation to them, are protected under the terms of a Creative Commons public licence (CCPL or licence). Any use of the online platform and its contents other than that authorised under this licence or provided for in intellectual property law is prohibited. By exercising any right on the online platform, you accept and consent to the limitations and obligations of this licence, without prejudice to the need for express consent in the event of prior violation of its terms. The licensor grants you the rights contained in this licence, provided that you accept these terms and conditions.
Access to or use of the content by the User shall not imply any waiver, transfer or total or partial assignment of the rights associated with the Creative Commons licence. The rights of use, alteration, exploitation, reproduction, distribution or public communication of such content are regulated by the Creative Commons licence as follows.
A. Licence grant.
In accordance with the terms and conditions of this licence, the licensor grants, for the term of protection of intellectual property rights and free of charge, a worldwide non-exclusive licence that includes the following rights:
- Right to reproduce, distribute and publicly communicate the online platform and/or its contents.
- Right to incorporate the online platform and/or its contents into one or more collections.
- Right to reproduce, distribute and publicly communicate the online platform and/or its contents lawfully incorporated into a collection.
- Right to extract and reuse the online platform and/or its contents from a database.
These rights may be exercised in all media and formats, tangible or intangible, known at the time of granting this licence. The aforementioned rights include the right to make any modifications that are technically necessary for the exercise of the rights in other media and formats. All rights not expressly granted by the licensor are reserved, including, but not limited to, the impossibility of offering or imposing any condition on the work or service that alters or restricts the terms of this licence or the exercise of its rights by the licensees, as well as the inalienable moral rights recognised by applicable law. To the extent that the licensor holds exclusive rights under current national law implementing the European directive on sui generis rights in databases, it expressly waives such exclusive rights.
B. Limits on rights.
Nothing in this licence is intended to reduce or restrict any legal limitations on the exclusive rights of the intellectual property rights holder in accordance with the Intellectual Property Law or any other applicable laws, whether arising from legitimate uses, such as private copying or quotation, or other limitations such as those resulting from the first sale of copies (exhaustion).
DISRUPTIA is the owner of the elements that make up the graphic design of the online platform, the menus, navigation buttons, code, texts, images, textures, graphics and any other content on the website or, in other cases, has the corresponding authorisation for the use of such elements.
All trademarks, trade names or distinctive signs displayed on this online platform are the property of DISRUPTIA and/or third-party companies. It is prohibited to use or download them permanently, copy them or distribute them by any means without the mandatory consent of their owner.
In the event that any User or third party considers that any of the content has been introduced into the online platform in violation of their Intellectual or Industrial Property rights, they must send a notification to DISRUPTIA identifying themselves and the owner of the intellectual or industrial property rights allegedly infringed, providing proof of ownership or accreditation of representation of the aforementioned rights.
5. Data protection.
For information about the use of your data, please see our Privacy Policy.
6. Applicable legislation and jurisdiction.
These General Terms and Conditions shall be governed by Spanish law. For any issues that may arise between the parties in relation to the interpretation and execution of this document, both parties expressly agree, waiving any other jurisdiction that may apply, to the jurisdiction of the Courts and Tribunals of Las Palmas.
